The Guide to Legal Drone Real Estate Photography in Europe
Real estate drone photography is now becoming a standard requirement for property marketing across Europe. Shooting properties in urban and suburban environments introduces a new complex web of legal liabilities for commercial drone operators to prepare for. Between the EASA flight regulations, GDPR, and national trespassing laws, remote pilots must navigate strict boundaries so to operate legally.
Decoding EASA Categories for Real Estate
The most critical factor in real estate drone operations is your UAV’s weight and its C-class identification label. Because property shoots inherently take place in residential, commercial, or urban areas, falling into the wrong EASA category can ground your operation entirely.
The “Golden” Subcategory
Open A1 (C0 & C1 Drones)
For most real estate photographers, the A1 subcategory offers the most operational freedom in tight residential lots.
- C0 Drones (< 250g): Legally fly in urban areas. Brief overflight of uninvolved people allowed (no assemblies).
- C1 Drones (< 900g): Requires A1/A3 Proof of Completion. Urban flight allowed, but must strictly avoid overflying uninvolved people.
The “Heavy” Subcategory
Open A2 (C2 Drones up to 4kg)
If you fly heavier, professional-grade rigs carrying a C2 label, you operate in the A2 subcategory. Explicitly requires the A2 Remote Pilot Certificate.
- The 30-Meter Rule: You must maintain a 30-meter horizontal distance from uninvolved people.
- The 5-Meter Rule: If your drone has a selectable low-speed mode, you can reduce this safety buffer to just 5 meters.
The Legacy Drone Trap
Since January 1, 2024, drones placed on the market before 2024 without a C-class label that weigh over 250g are automatically relegated to the A3 subcategory. The A3 rules mandate staying 150 meters away from residential, commercial, industrial, and recreational areas. If you are still shooting real estate with a legacy drone without a C-class label, you cannot legally fly in a neighborhood.
When Do You Need STS-01?
While the Open Category covers the vast majority of standard property shoots, specialized commercial operators often hit a regulatory wall in dense urban centers. You must move to the Specific Category and operate under a Standard Scenario (STS-01) if:
-
1
You require a controlled ground area: STS-01 allows operations over a controlled ground area in a populated environment. This is vital when cordoning off a city block or commercial site where A2 distance requirements cannot be guaranteed.
-
2
You are flying a C5-class drone: Or a retrofitted C3 drone for more complex visual line of sight (VLOS) missions.
-
3
You need advanced operational authority: Passing the STS theoretical and practical exams gives agencies the regulatory backing to execute high-risk urban commercial real estate shoots safely.
Navigating Privacy, GDPR, and Private Property
Aviation law dictates where the aircraft can fly, but data protection and national laws dictate what you can capture.
| Legal Framework | Application to Real Estate Photography |
|---|---|
| EASA Regulations | Governs airspace safety. Pilots can transit airspace above private property provided they maintain required distances from uninvolved people. |
| GDPR | Prohibits the deliberate capture, public sharing, or storage of identifiable personal data (e.g., faces, neighbor’s license plates) without explicit consent. |
| National Trespass & Nuisance | Property owners possess rights to their immediate lower airspace. Prolonged hovering, flying excessively low, or recording into a neighbor’s private space constitutes actionable trespass. |
The Neighbor Dilemma
You can generally transition through the airspace above a neighbor’s yard to frame your target property. However, if your camera deliberately films their fenced-in backyard or records through their windows, you violate privacy and anti-surveillance laws. Always angle the gimbal strictly toward the client’s property or blur identifying details of adjacent lots in post-production.
